US Court Mandates Release of Abrego Garcia from ICE Detention

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks legal authority.

"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.

The situation stems from a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling allegations, he was detained in federal detention.

In her decision, the judge noted that the government lacks a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."

Background of the Case

The court challenge involve disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.

He has also pleaded not guilty to the smuggling counts, which are part of a separate trial in Tennessee.

The court, who was overseeing his challenge to removal in a federal court, determined that he must now comply with the conditions of his release from custody in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
